What It Means

The Patent Prosecution Highway is an international framework that allows patent applicants to fast-track the examination of a patent application in one country based on a positive examination result in another country’s patent office. For example, if the European Patent Office (EPO) allows certain claims, the applicant can ask the US Patent and Trademark Office (USPTO) to accelerate examination based on those claims.

It doesn't mean the new application will automatically be granted, but statistics suggest that there is a higher rate of grant for PPH patents versus non-PPH patents.

Why It Matters
By leveraging examination already done elsewhere:
Reduces time to grant
Fast-tracks examination, often cutting years off the time it takes to secure a patent in key markets. This means protection comes sooner, which helps deter competitors, impress investors, and strengthen your market position.
Saves on prosecution costs
Minimises back-and-forth with patent examiners, reducing legal fees and administrative burden. You're reusing claims and arguments that have already been approved.
Strengthens investor confidence
A pending or granted patent in a major jurisdiction like the US or EU, achieved quickly, can significantly boost investor trust and valuation - highlighting progress in securing IP protection.
